Does GDPR affect members of the Expert Group and your profile? Yes – each members of the Expert Group, as an individual or part of an organisation, need to be GDPR compliant. Every Group member who processes personal data as part of their work will be accountable to individuals and to the Information Commissioner. As a member of the Expert Group you are asked to review your personal data at least once a year. Please contact us if there is any data/information which you wish to amend or remove.

What does GDPR mean for members of the Expert Group? Our data policy is as follows; As an open access website, directory and telephone service we market your data to solicitors, barristers, courts of law and legal professionals.

Before we publish your data, you will be supplied with a proof for approval.

During your membership you can request reasonable changes to your data and subsequent proofs will be provided.

At any time, your data can be removed at your instruction or our unilateral decision.

In accordance with current legislation and the Data Protection Act, we ensure that all our employees follow strict rules called ‘data protection principles’. Our principles are, your information is: Used fairly and lawfully. Used in a way that is adequate, relevant and not excessive. Accurate to the best of our knowledge. Kept for no longer than is appropriate. Handled according to people’s data protection rights. Kept safe and secure (server updates and physical storage).

Independence Policy

“Expert evidence should be the independent product of the expert”.

This statement, which is drawn from Practice Direction 35 issued by the Ministry of Justice, sets out a high level and key aspect of Expert evidence.

While the main focus of the Practice Direction relates to the importance of an Expert’s evidence being independent from the interests of the case being presented by the party that has appointed the Expert, it is equally valid and relevant in other respects.

There is no prohibition or limitation on appropriate research undertaken by an expert witness, but the evidence given by the expert witness must represent his/her own views based on his/her own knowledge.

It is the policy of FS Expert Group that Experts connected to the Group should always provide evidence that fully conforms to the requirements and expectations of the Court. In order to reinforce the independence of our Experts, we make clear that we expect at all times to maintain all required, and all appropriate, confidentiality in relation to any case which we are or may become involved with.

We emphasise that such confidentiality is as important in relation to any communication with another Group Expert as it is when communicating with any other person.

Any known or alleged breach of this policy must immediately be reported to the Managing Director of FS Expert Group, providing all relevant details.
